1. Key points outlining important details of the terms and conditions.

1.1) These terms and conditions (“Agreement”) form an integral part of your contract with Knights Jewellery Ltd (“we,” “us,” or “our”) for the purchase or sale of goods through knightsbullion.com (“Website”) or in our physical showroom located at 42 Wood Street, Stratford on Avon, Warwickshire, CV37-6JG, United Kingdom.

1.2) Please ensure that you carefully read and retain a copy of these terms and conditions for future reference. We reserve the right to modify any part of this Agreement and will notify you of such changes on our Website.

1.3) Any changes made to the terms and conditions will not affect the contracts entered into prior to the date of the changes.

 

2. Who we are.

2.1) We are Knights Jewellery Ltd, a company registered in England and Wales under Company Number 08401399, with our registered office located at Unit 3 Woodgrove Farm, Fulbrook Hill, Fulbrook, Oxfordshire, United Kingdom, OX18 4BH. Our VAT registration number is 159213803.

2.2) How we contact you. We will contact you using the telephone number, email address, or postal address that you have provided to us during the order process.

2.3) Business day. The term “Business day” refers to any day that is not a Saturday, Sunday, or a day recognized as a public holiday in England.

 

3. Requirements to contract when using our services.

3.1) To use our services, you must meet the following requirements:

  • i) Age:
    You must be at least eighteen (18) years old, and we may request identification to verify your age.
  • ii) Residency:
    You must be a resident of the United Kingdom, including Northern Ireland, and we may request proof of address to verify your residency.
  • iii) Acting on your own behalf:
    You must act on your own behalf and not on behalf of any other person or entity.
  • iv) Acceptance of terms and conditions:
    You must fully understand and accept these terms and conditions.
  • v) Notification of changes:
    If any changes to your personal details occur during the transaction period, you must promptly inform us.

3.2) Orders can be placed by contacting us via telephone using the provided number or through our website. By placing an order, you confirm that you are legally capable of entering into a contract. Please note that receiving an automated response after placing an order does not constitute formal acceptance of the order. The order will be considered accepted once you receive confirmation of dispatch. Until that point, we acknowledge the possibility that circumstances beyond our control may prevent us from fulfilling the order. If we are unable to accept your order, we will notify you in writing, and no agreement will be established between us. Reasons for our inability to accept your order may include, but are not limited to, the following:

  • i) Product availability:
    The product is out of stock and cannot be sourced within a reasonable time frame.
  • ii) Discrepancy in description or price:
    We have identified a discrepancy in the description or price of the product selected for the order.
  • iii) Incorrect ID and address documentation:
    You have failed to provide the correct identification and address documentation as requested.
  • iv) Non-compliance with anti-money laundering requirements:
    You have not satisfied our anti-money laundering requirements as outlined by HMRC as follows:We have a legal obligation to comply with UK Government and European Union (EU) regulations on Anti Money Laundering, Fraud, and Terrorism. As a business, our responsibility is to conduct necessary checks and establish systems to prevent money laundering and combat financial crime. The Money Laundering Regulations 2007 require the collection of appropriate identification when specific transactions occur. The regulations stipulate that due diligence must be carried out by Knights Jewellery LTD in the following scenario: “conducting an occasional transaction with a customer valued at £10,000 or more.”
  • v) Please note:
    Each transaction undergoes a fraud screening process facilitated by our secure gateway. If necessary, we may request identification from you to verify your identity as the customer.

3.3) If any of the details provided are incorrect, you are obligated to notify us promptly and make the necessary amendments. You are solely responsible for providing accurate information, especially for the delivery of your order, with a particular emphasis on your address.

 

4. Products.

4.1) We provide investment-grade precious metal products, including bars, coins, and casting grain. We acknowledge the exceptional skill involved in providing these products in their described form; however, no other warranty is accepted in relation to their provision.

4.2) Please note that the products may have slight variations from the images displayed on our website. While we make every effort to accurately display the products, we cannot guarantee that the colour of the products will be accurately reflected on your device’s display. Additionally, the packaging of the products may slightly vary from the images shown.

 

5. Providing payment.

5.1) We accept payments up to the value of £5000.00 on Credit cards and £20000.00 on Debit cards. Please note that we do not accept payments made with Credit/Debit cards registered outside of the United Kingdom.

5.2) We do not accept without prior agreement payments made with Commercial or Business Credit cards. If payments are made using these means, we reserve the right to charge a 2.5% fee to offset the high processing charges associated with these card types. In such cases, we also reserve the right to hold the goods until the fees are settled in full before dispatching the order.

5.3) For payments made by bank transfer, we accept amounts up to the value of £50000.00. Payments made by bank transfer must include the order number generated by our system during checkout within 24 hours. Failure to associate the order number with the payment reference may result in the cancellation of your order or an additional charge to account for the fluctuation in the metal price between the time of order and the time of error realization. Orders not paid for within 24 hours and not cleared by our bank may be refused, and no agreement will exist between us.

5.4) Once we have received payment through the Take payments payment portal or cleared funds in our bank account, we will proceed to process your order. In case of any issues during the payment process, we may contact you using the contact details provided during the ordering process.

5.5) For orders exceeding £5000.00 or if the total purchases by the Buyer exceed £10000.00 within a twelve-month period, we may request copies of the Buyer’s most recent passport and driver’s license (or a copy of a utility bill dated within the last 3 months) showing their home address. Any information provided will be handled in accordance with the Data Protection Act 1998 and will not be disclosed to unauthorized third parties. Customers are welcome to send us original documents via Royal Mail special delivery. We will copy and certify the documents and return the originals via Royal Mail special delivery.

5.6) All payments are to be made in GBP (British Pounds). If payment is made in other currencies, you are responsible for ensuring that any bank charges for currency conversion are fully covered by you.

5.7) Please note that all card payments are subject to validation checks and authorization by the card issuer. We may also validate the information provided during registration and the order process using commercially available sources, including credit reference agencies and the Electoral Roll.

5.8) Cash payments for orders through Knightsbullion.com are not accepted due to high processing fees charged by our bank. Please refrain from depositing cash payments into our account, as they will not be refunded until ownership and origin can be proven to our absolute satisfaction. In case of cash deposits received, adjustments will be made to reflect fees imposed by our bank, and an administration fee of £200.00 plus VAT will be applied to compensate us for the time required to process the matter.

5.9) In the event of an unjustified chargeback request, we reserve the right to charge interest on the overdue amount at a rate of 1% per year above the Bank of England base lending rate or 1% per year if the base lending rate is below zero. Interest will accrue daily from the original date of payment until the overdue amount is settled. The interest must be paid along with the overdue amount.

 

6. Delivery

6.1) You are required to provide an accurate and current delivery address at the time of placing your order. If you are using a credit or debit card, the delivery address must match the registered billing address of the cardholder. We will only deliver goods to the registered billing address of the card and not to any other address.

6.2) Free delivery is included for products within the United Kingdom. All deliveries are fully insured by us up to a value of GBP £30000.00, insured by Lloyds of London. If your order exceeds this value, multiple parcels will be sent, and each parcel will be dispatched separately.

6.3) Orders that are received, paid for with cleared funds, and confirmed by us with a dispatch confirmation will be posted out on the following business day (excluding Saturdays, Sundays, and public holidays in England) unless otherwise specified via email and confirmed by us in writing.

6.4) In the dispatch confirmation, we will provide you with the anticipated dispatch date and estimated time of arrival based on the applicable delivery method for your order. If you wish to request a different delivery date, you must notify us immediately via email. If no request for a different delivery date is made, we will dispatch your order as specified.

6.5) Bullion purchased on the website and paid for by bank transfer may be collected from our showroom at 42 Wood Street, Stratford-on-Avon, Warwickshire, CV37-6JG during office hours. Please note that collection is strictly by appointment only. Photographic identification is required without exception, and the goods will remain in our custody until your identity is verified. We do not offer this service for other payment options due to the potential for fraud.

6.6) While we make every effort to meet delivery schedules once the dispatch of an order has been confirmed, please note that delivery schedules should be viewed as indicative and not contractual due to circumstances beyond our control.

6.7) When the products are ready for dispatch, they will be shipped using the Royal Mail delivery service or an alternative carrier if necessary. It is the responsibility of the delivery service to deliver the items to the specified address, not to a specific individual.

6.8) If you are unable to personally receive the parcel, it is your responsibility to ensure that there is an authorized person available to receive it. If no one is available to accept the delivery, the courier will leave a failed delivery note and make arrangements for redelivery or collection from a Royal Mail collection office or courier depot.

6.9) Personal identification and address information will be required in such cases. The delivery will be considered completed when the metal is received at the delivery address by a person claiming to be an authorized recipient. Persons claiming to be authorized recipients may be asked by the courier to verify their identity.

6.10) We will not accept any liability for any delivery that has been accepted at your address but not received by you. Orders will be deemed to be delivered once they are signed for by any person at the delivery address or confirmed as delivered or collected by our couriers.

6.11) Upon receiving the product, it is your responsibility to examine the parcel for signs of damage or tampering before accepting the delivery, as the insurance coverage ends upon delivery. If you observe any evidence of damage or tampering, you must reject the parcel and instruct the courier to return it to us immediately, before accepting the delivery. In such cases, you must inform us in writing via email. If you accept the delivery despite damage or tampering, the insurance policy provided will be void, and we will not be held responsible for any losses incurred.

6.12) If you do not receive your order within the estimated delivery time slot despite it being arranged for delivery, you should immediately notify us via email, quoting your order reference number and any delivery notifications received. We will then inquire with Royal Mail or the relevant courier service, if applicable. If we determine that the delivery is lost, we will initiate an investigation and claim with the insurers. Please refrain from initiating contact with the courier, as it could jeopardize any subsequent investigation.

6.13) Depending on the outcome, at our discretion, we may offer a replacement order or a refund following the investigation. We reserve the right to charge you for the replacement order upon completion of the investigation. In the event that a customer is found to have acted fraudulently, we are not obligated to replace the order or refund the purchase price.

6.14) Ownership of the goods transfers to you once we have received payment in full and the funds have cleared. Until such time goods are delivered, we are liable and responsible. You are responsible for the goods from the time the parcel is delivered to your address and signed for by someone at the address, or from the time you collect the product from our showroom, where applicable.

 

7. Your Rights to end the contract.

7.1) You have the right to terminate the contract with us if the product is faulty, damaged, or misdescribed.

7.2) In most circumstances, there is no statutory right to change your mind and receive a refund unless authorized by the Managing Director. Purchases are subject to the fluctuations of prices in financial markets, and therefore, the acquisition of metal is exempt.

7.3) Due to the dynamic nature of the precious metals market, all agreed order cancellations are subject to fees to cover the costs of selling products back into the open market, along with an administration fee of £100.00 plus VAT. These fees will be deducted from the funds held by us for the original purchase.

7.4) Ancillary Products, such as coin tubes, boxes, and other non-market-dependent products we may offer, are covered under the statutory Consumer Contracts regulations. You have the right to change your mind within 14 days and receive a full refund of the price paid, excluding original shipping fees. The goods must be returned in the same condition as supplied.

7.5) You have the right to terminate the contract in the following circumstances:

  • i) We have notified you about changes to the product or changes to the terms that you do not agree to.
  • ii) We have notified you about an error in the price or description of the product to be supplied, and you do not wish to proceed.
  • iii) There is a significant risk that the supply of agreed products may be delayed due to events beyond our control.
  • iv) You have the legal right to terminate the contract due to breaches of the agreed terms.

 

8. Ending the contract

8.1) To terminate the contract, you must contact us by calling 01789266595 or emailing us at info@knightsbullion.com. Please provide your name, address, order details, phone number, and email address.

8.2) If you choose to terminate the contract under the aforementioned terms after the order has been dispatched or you have received it, you must return the product to us either by post or in person at 42 Wood Street, Stratford upon Avon, Warwickshire, CV37-6JG. 8.3) While the product is in your possession, you are responsible for its safekeeping, and it should be returned to us with appropriate insurance covering the full purchase price. We assume no liability if the product is lost or stolen during transit to us.

8.4) We will cover the cost of return if the products are faulty, damaged, misdescribed, or if you are terminating the contract due to breaches of the agreed terms.

 

9. Our rights to end the contract.

9.1) We reserve the right to terminate the contract in writing under the following circumstances:

  • i) If you fail to provide us with the necessary information within a reasonable time to fulfil your order.
  • ii) If, after making payment for the product, you initiate a dispute (unjustified chargeback request) with your credit card provider without valid justification, leading to a demand from the credit card provider for a refund of the incurred loss.
  • iii) If you fail to allow us to deliver the products to you or collect them from us within a reasonable time.
  • iv) If you have not provided us with the correct ID and address documentation as requested.
  • v) If you have not satisfied our anti-money laundering requirements as outlined by HMRC.

9.2) In the event that we terminate the contract based on any of the reasons outlined in section 9, we reserve the right to charge you reasonable compensation for the net loss we incur due to the breach of the contract. This may include any loss suffered by us as a result of fluctuations in metal prices since the date the agreement came into effect.

 

10. Notifying us about a problem with the product.

10.1) We are committed to fulfilling our legal obligations by supplying products that conform to the contract, which include the following:

  • i) The products being of satisfactory quality.
  • ii) The products being fit for the purpose for which they are normally supplied.
  • iii) The products matching the description provided.

10.3) Replacement or refund of the product. If the product is found to be faulty or damaged and you would like us to replace it, please inform us. Upon agreeing that the product is indeed faulty or damaged, we will arrange for a replacement within a reasonable timeframe after you have returned the product and notified us of your preference for a replacement.

10.4) We will cover the costs associated with returning the product, and you will be provided with a postage receipt for verification by sending it to info@knightsbullion.com. If it is not possible to replace the product within a reasonable timeframe due to unavailability of stock, we will refund the price you paid for the product as soon as possible. Generally, this will be refunded using the same means of payment you initially used, although with your agreement, alternative refund methods may be considered.

 

11. Pricing and Payment Information

11.1) All prices displayed on our website are in GBP and can be found in the relevant section. The prices are presented as “live prices” sourced from third-party suppliers. While we make reasonable efforts to ensure the accuracy of this information, we cannot be held responsible for any inaccuracies in the third-party “live price” feed. Please note that the presence of a “live price” attached to a product does not guarantee its availability.

11.2) The prices of gold, silver, and platinum are subject to constant fluctuations. Therefore, most of our products are susceptible to price changes before you place your order. The price of products ordered through our website will be quoted on the checkout page at the time of placing your order. We recommend refreshing your screen immediately before confirming your order to view the most up-to-date price. For orders placed over the phone, a sales representative will provide the price prior to confirming your order.

11.3) Please be aware that buying and selling precious metals involves speculation. Prices are influenced by market forces, political circumstances, demand, and other determining factors. We cannot be held responsible for any losses incurred as a result of purchasing the metal.

11.4) In the event that the VAT rate changes between the date of your order and the date of product delivery, we will adjust the VAT rate you pay unless you have already paid for the order in full.

11.5) Although we make every effort to ensure the accuracy of prices listed on the website, errors may occur. We typically verify prices before accepting your order. If the correct price is lower than the one stated, we will adjust the amount and charge you the lower price. If the correct price is higher than the one stated, we will adjust the amount and contact you for further instructions before accepting the order.

11.6) If we accept and process your order despite an obvious and unmistakable pricing error that should have been recognized by you, we reserve the right to terminate the agreement. In such cases, we will refund the amount you have paid and request the return of any products provided.

 

12. Liability for Loss or Damage

12.1) In the event of our failure to comply with these terms and conditions, we accept responsibility for any loss or damage you may suffer as a result of our breach of this agreement and our failure to exercise reasonable care and skill. However, we do not accept liability for any loss or damage that is not reasonably foreseeable.

12.2) We do not seek to exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury, liability for fraud or fraudulent misrepresentation committed by our employees, agents, or subcontractors.

12.3) These terms and conditions specifically apply to products intended for domestic and private use. We do not accept liability for any loss of profit, loss of business, business interruption, or loss of business opportunity that may arise from the use of the products in any commercial, business, or sales application.

 

13. Other Important Terms

13.1) While the Website is professionally maintained, the Company cannot assume any liability for:

  • i) Incompatibilities of the Website with other websites, services, software, and/or hardware.
  • ii) Viruses, spyware, or any other insecure and disabling features that may affect access or use of the website.
  • iii) Modification, temporary unavailability, or discontinuance of the Website.

13.2) The Courts of England and Wales shall have jurisdiction in respect of any dispute arising from these terms.

13.3) Even if we delay enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you for breaking this contract, that will not waive your obligations and it will not prevent us from taking steps against you at a later time.

13.4) We may transfer our rights and obligations under any contract formed under these terms between you and us to another organization. We will notify you if we plan to do this.

13.5) You may only transfer your rights or obligations under any contract between you and us to another person if we agree to this in writing.

13.6) Any contract formed under these terms is between you and us. No other person shall have any rights to enforce any of its terms. Neither party will require the agreement of any other person to terminate the contract or make any changes to these terms.

13.7) Each clause of these terms operates separately. If any court determines that any term of a contract formed under these terms is unlawful, the other clauses will remain in full force and effect.

 

14. RISK NOTICE:

All investments involve a level of risk. We sell and buy Metal products based on global metal market prices, which are outside our control and subject to frequent changes. The historical performance of global metal market prices should not be relied upon as an indicator of future prices. Knights Jewellery LTD does not provide investment advice.
